Article III, Section 3, defines treason as either “levying War” against the United States or “adhering to their Enemies, giving them Aid and Comfort.” This narrow scope was intentionally designed by the Founding Fathers to prevent the misuse of treason charges for political retribution. To secure a conviction, the prosecution must present testimony from two witnesses to the same overt act or obtain a confession in open court. Historically, treason prosecutions are exceedingly rare; since the nation’s founding, only about 40 federal cases have been pursued, with the last conviction occurring in 1952. The rarity of such charges underscores the high evidentiary standards and the specific criteria that must be met. In contemporary contexts, actions that might be perceived as betraying national interests are more commonly prosecuted under statutes addressing espionage, sedition, or other related offenses, rather than treason. This legal framework ensures that treason remains a narrowly defined crime, preventing its application based solely on political disagreements or unpopular policies.
